The Delhi High Court has granted permission to BharatPe's former managing director Ashneer Grover and his wife Madhuri Jain Grover to travel to the US from May 26, 2024 to June 12, 2024 - but on 'certain conditions'.

The couple recently moved the high court seeking permission to travel to the US for their children's summer course and to meet their extended family. However, the Economic Offences Wing (EOW) of the Delhi Police raised objections to the applications stating that if the husband and wife are allowed to travel abroad, there is a strong possibility that they will not return to the country.

On this, Grover's advocate suggested that instead of allowing the couple to go together, Grover should be allowed to leave for the US on May 26 and return on June 14, while Jain will travel on June 15 and return on July 1 to India.

Allowing Grover and his wife to travel to the US 'separately', Justice Subramonium Prasad asked them to furnish "a security of Rs 80 crore in the form of FDR (Fixed Deposit Receipt) before the learned Registrar of the court," before they travel to the US.

The court, in its order today, asked Grover's wife Madhuri Jain shall not leave the country during the period Grover is travelling abroad and "shall deposit her passport with the investigating authority till he returns back to India."

The petitioner have been asked to deposit title deeds of their property at Camellias, DLF Phase V, Gurgaon. And, that the petitioner "shall not transfer, alienate or create any third party rights in the mentioned property during his stay abroad," the court order reads.

In addition, Grover has been asked to deposit his Emirates ID issued by the United Arab Emirates (UAE) government with the court.

The couple has also been asked to provide all the details of the itinerary, including his stay, hotel, phone numbers, and also furnish a copy of his travel tickets to the court.

"The petitioner shall share his location twice a day with the investigating officer during his stay abroad," the court ordered. Additionally, any application for the extension of stay abroad will not be entertained.

The court has asked Grover to file an undertaking that he will not alienate his shares in BharatPe or any of its assets during the period of travel.

According to a source, who did not wish to be named, "Grover and his wife informed the Registrar that there is 'some error in the court’s order where instead of property to the tune of Rs 80 crore being given as security, the order says FDR'. He requested the Registrar that his children are travelling on May 26 and this must be done today because a parent has to travel with the minor kids."

"But, the couple have been informed that if they have any problem with the order, they can move an application for modification on Monday."

The EOW, in November 2023, issued a Look Out Circular (LOC) against Grover and his wife -- who are accused of committing a Rs 81-crore fraud at BharatPe. They need the court's permission to travel outside the country.
